1. Acceptance of Terms
These Terms of Use ("Terms") govern your access to and use of the website operated by Himmelstein & Adkins, LLC ("Firm," "we," "our," or "us") for RefundArrow ("Site"). By accessing or using this Site, you agree to be bound by these Terms. If you do not agree, do not use this Site.
2. Purpose of This Site
This Site is operated for the purpose of providing general information about the Firm's legal services relating to the recovery of tariff payments made under the International Emergency Economic Powers Act ("IEEPA") and for collecting information from prospective clients. This Site is not intended to provide legal advice. The information on this Site is general in nature and should not be relied upon as a substitute for consultation with a qualified attorney regarding your specific circumstances.
3. No Attorney-Client Relationship
Your use of this Site, including the submission of information through any form, does not create an attorney-client relationship between you and the Firm. An attorney-client relationship with Himmelstein & Adkins, LLC is established only upon the mutual execution of a formal written engagement letter. Until such an engagement letter has been fully executed by both you and the Firm:
- No attorney-client relationship exists between you and the Firm.
- The Firm has no obligation to represent you, to maintain the confidentiality of information you submit (except as described in our Privacy Policy), or to refrain from representing parties whose interests may be adverse to yours.
- You should not submit sensitive or privileged information through this Site that you would not want disclosed absent an attorney-client relationship.
- The Firm is under no obligation to accept your matter or to respond to your inquiry.
4. Use of Submitted Information
Information you submit through this Site will be used for the purpose of evaluating whether you may have a viable IEEPA tariff refund claim and determining whether the Firm is able to offer representation. By submitting information, you consent to its collection, use, and storage as described in our Privacy Policy. You represent that all information you submit is accurate and complete to the best of your knowledge.
Submission of information does not obligate the Firm to represent you or to take any action on your behalf. You will not be considered a client of the Firm unless and until a formal engagement letter has been executed.
5. No Guarantee of Results
The recovery of IEEPA tariff refunds involves an evolving and unsettled area of law. While the Supreme Court of the United States has ruled that IEEPA tariffs were unlawful, the administrative and judicial processes for obtaining refunds are unprecedented, and the outcome of any individual claim cannot be predicted or guaranteed. Nothing on this Site constitutes a guarantee, warranty, or prediction regarding the outcome of any legal matter. Prior results do not guarantee a similar outcome.
6. Contingency Fee Disclosure
If the Firm agrees to represent you, representation will be on a contingency fee basis, meaning you will owe no attorney's fees unless and until the Firm obtains a recovery on your behalf. The specific terms of the contingency fee, including the applicable percentage, will be set forth in your engagement letter. The contingency fee disclosure on this Site is for informational purposes and does not constitute an offer of representation or a binding fee agreement.
7. Intellectual Property
All content on this Site, including text, graphics, logos, and design elements, is the property of Himmelstein & Adkins, LLC or its licensors and is protected by applicable intellectual property laws. 12. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or your use of this Site shall be subject to the exclusive jurisdiction of the state and federal courts located in Maricopa County, Arizona.
13. Attorney Advertising
This Site may be considered attorney advertising in certain jurisdictions.
